ASSUMPTION OF RISK - INDEMNITY

TO: Scenic City Velo (SCV); its officers, members, and sponsors.

RE : Participation in Scenic City Velo organized rides, Scenic City Velo sponsored bicycling races, Scenic City Velo sponsored events, and any bicycling race in which a Scenic City Velo Member participates.

Each undersigned person ("Releasor') requests permission as a Scenic City Velo (SCV) Member to participate in SCV events, including but not limited to, SCV organized rides, SCV sponsored bicycle races, SCV sponsored events and any bicycle race as an SCV member. In consideration of such permission, I (each of the undersigned) for myself, my personal representative, heirs, spouse, successors and assigns, DO HEREBY:

1. For myself, or on behalf of the minor I am signing for, as appropriate release, discharge and covenant not to sue the Releasees from any and all claims, demands, actions, executions, judgments or liability, present or future, arising out of strict liability or negligence of Releasees or any other person or participant, or otherwise, which causes for the undersigned injury, death, damages or property damage.

2. Understand that operating and riding a bicycle involves DANGER AND RISK OF INJURY OR DEATH which danger and risk I appreciate and voluntarily assume, because I choose to do so.

3. Acknowledge that no waiver of any of the provisions of this release has been made to me and I understand and agree that none would be effective.

4. Agree that this agreement shall apply to any incident, injury, accident or death that may occur. Releasor understands that it is not the purpose or intent of the Releasees to teach safety rules, nor to serve as the guardian of Releasor's safety and Releasor expressly agrees that this release, waiver, and covenant not to sue is intended to be as broad and inclusive as permitted by the laws of the State of Tennessee and that if any portion of this agreement is held invalid, it is agreed that the balance shall, notwithstanding the partial invalidity, continue in full legal force and effect. Releasor further releases all of the Releasees from any and all damage or claim whatsoever on account of first aid, treatment or service rendered Releasor or arising from any and all injuries sustained. Releasor affirms that he or she understands that the terms of this agreement are contractual and not a mere recital, and that he or she has signed this document as his or her own free act. This is a Tennessee contract and shall be construed according to the laws of that state.

5. Covenants to hold Releasees harmless and indemnify Releasees from any claim, demands, actions, execution, judgment, liability, or expense, present or future, Releasees may incur arising out of Releasors participation in SCV organized bicycle rides, SCV sponsored bicycle races, SCV sponsored events and any bicycle race. If signing on behalf of a minor, I agree to hold harmless and indemnify Releasees from any claims brought by such minor.

I HAVE READ THIS DOCUMENT. I UNDERSTAND IT IS A RELEASE OF ALL CLAIMS.
I UNDERSTAND I ASSUME ALL RISKS INHERENT IN OPERATING A BICYCLE.
I VOLUNTARILY SIGN MY NAME EVIDENCING MY ACCEPTANCE OF THE ABOVE PROVISIONS.
